The Estate Mortgage Home Page

The information stored on the Court System during the Estate Mortgage Litigation was accessible from any computer workstation attached to the in-court network by viewing the Estate Mortgage Home Page using an Internet/Intranet Browser such as Netscape Navigator or Microsoft Internet Explorer.

The Estate Mortgage Home Page acted as a menu, linking to each area of data using hypertext links. By clicking on the link it was possible to navigate to any information available on the system.

To assist in the management of information included and to ensure that there was control, by the court, on the information stored on the court system, and in particular controls over what information became part of the electronic court record, the home page was divided into three sections. These were;

  • Court Records,
  • Proposed Modifications to the Court Records, and
  • Administration.

THE COURT RECORDS

The top section of the home page, the Court Records section, included all information that had become part of the official electronic court record.

Once information had been accepted by all parties a "ruling/order" was made that allowed that information to be included in the electronic court record.

The electronic court record included;

  • Courtbook database and attached image library,
  • Courtroom information services,
  • Reasons for Rulings and Judgements,
  • Pleadings,
  • Aide-Memoires, and
  • Evidence, Witness Statements & Exhibits.

Courtbook Database and Attached Image Library
The courtbook database and image library was developed using the data collection and imaging undertaken by the parties during the discovery process.

The "Bprod" document numbering system that had been agreed on by the parties through the document discovery was used as the "key" indicator for each document.

Through the home page it was possible to access images of courtbook documents and the related data using a number of different types of searches. Individual selections could be made through each search screen. For each search conducted, a list of documents meeting the criteria was displayed. From the displayed list the particular document of interest could be viewed by clicking on the highlighted document number, which acts as a hypertext link to the document image. The document image display is constant throughout the court system.

When using the image view, the first page of the document is automatically displayed. On the left of the image is a menu bar that allows access further information regarding the particular document, to view images of other pages in the document or move to other areas in the court system. To move between pages of the document highlighted page numbers for each page of the document are listed, it was possible to move to any page of the document. An indicator of the exhibit status of the document was displayed, and a "NOTE" button allowing access to the further information regarding the document, in particular;

  • courtbook database details, and
  • tendering details,
which were included on the menu bar.

Also included in the courtbook database and image library section of the home page there was a refined search that allowed searching of the subset of the courtbook that had been tendered. The exhibit search screen was very similar to the searches of the main courtbook database.

Courtroom information services
The courtroom information services included:

  • realtime transcript,
  • historic transcript,
  • software public image view, and
  • transcript download.
The realtime transcript available from the home page operated through the intranet. It was possible to select different size realtime transcript windows to suit particular needs. When a document number was mentioned in court and recorded in the transcript the internet realtime transcript automatically turned the document number in the transcript into a link to the image view for that document.

The historic transcript page allowed viewing of the previous days transcript. The transcript could be selected by day number, date and page number.

The software public view displayed a private copy of the image currently being displayed by the courtroom operator. The copy of the image displayed in the software public view could be fully manipulated to allow private examination of the document.

The last courtroom information service is the transcript download. From the system it was possible to save edited copies of each day's transcript in a number of formats. Each participant could choose the transcript style that they required and save a private copy for their personal use.

Reasons for Rulings and Judgements
The links to Reasons for Ruling and Reasons for Judgement allow the view of the rulings and judgement from the case. It was possible to view the document and any linked images.

Pleadings
Likewise, the Pleadings link allows viewing of some of the pleadings from the case.

Aide-Memoires
Many written submissions that were presented to the court were produced as intranet documents, when these written submissions became part of the electronic court record they were included in the Aide Memoires Page.

The plaintiffs presented their complete opening with the aide of these pages. Each section of the Plaintiff's case was summaries as a narrative summary. Each narrative had a comprehensive index, by date, producing a clear chronology of events relating to each issue. Each time a document number was referred to it was highlighted and in turn linked to the image view for that document.

The Evidence, Witness Statement & Exhibit Page
The Evidence, Witness Statement & Exhibit Page included listing, by party, of all documents that had become Exhibits allowing easy access to the image view of all exhibits.


In all documents produced there were a number of levels and it was possible to view any imaged documents referred to.


THE PROPOSED MODIFICATION PAGE

The Proposed Modification Page was added to allow documents to be placed on the court system prior to them becoming part of the electronic court record.


THE ADMINISTRATION PAGE

The Administration Page provided access to information that was not part of the electronic court record.

Information accessible through the Administration Page included:

  • Document Download,
    allowing the parties to distribute files using the court system,
  • A software archive
  • A case directory,
    which was very important in the early stages of the hearing, and
  • On line help.
