This Seminar is open to judges from superior courts in Australia and overseas.

Background

Appellate judges' programmes have become common in the United States and Canada. Such programmes are designed not simply to deal with practical matters concerning appellate judges in their work but to look at topics of substantive law as well as interdisciplinary perspectives.

The AIJA is pleased to present an inaugural Appellate Judges' Seminar. The ideas for this Seminar have come from appellate judges both in Australia and New Zealand. The AIJA is grateful, particularly, to the Rt Hon Sir Kenneth Keith for his interest and assistance with the Seminar.

Appellate Courts and the Management of Appeals in Australia

Convenor: Ms Anne Wallace, Deputy Executive Director, AIJA
Mr Brian Opeskin, Commissioner, Australian Law Reform Commission.

Mr Opeskin is the author of the AIJA publication "Appellate Courts and the Management of Appeals in Australia" and was also Commissioner in charge of the inquiry into "The Judicial Power of the Commonwealth: A Review of Judiciary Act 1903 and Related Legislation" for the Australian Law Reform Commission.

This session is designed to look at several matters of relevance to the management and disposition of appeals. Adequate time will be made available for discussion in relation to the matters raised.

Electronic Appeal Books

Ms Allison Stanfield, Director, <e.Law> Australia Pty Ltd.

In recent years a number of Australian courts have begun to use technology to assist with the process of managing appeal books. This session will provide a demonstration of the type of software available and will include a judicial perspective on its use.

SESSION FIVE

The Role of Appellate Courts in Sentencing

Convenor: The Hon Justice Frank Vincent, Court of Appeal, Victoria
Professor Arie Freiberg, Department of Criminology, The University of Melbourne.

Professor Freiberg will speak generally about matters of relevance to appellate courts in sentencing and will address the question of guideline judgments raised by the appeal to the High Court in Wong v The Queen (argued before the High Court on 1 and 2 May 2001).
